NAFTA
NAFTA is the North American Free Trade Agreement. It governs trade between the United States, Canada and Mexico.
Eligibility
If you are a Canadian or Mexican professional, you may work in the U.S. if:

- your profession is on the "NAFTA Professions" list
- the position you plan to take requires a NAFTA professional
- you will be working in a prearranged full-time or part-time job for a U.S. employer, and
- you have the qualifications of the profession

Spouses and Children
NAFTA Professionals can bring their spouses and unmarried minor children. Dependents do not have to be citizens of Mexico or Canada. They may not work while in the U.S. but they may study.

Canadian Citizens
In most cases, Canadian citizens do not need visas. They may enter the U.S. without a visa if they have the proper documentation.
Mexican Citizens
Mexican citizens must still possess a visa to enter the United States.
Visa Interview
Most visa applicants must undergo an interview at the embassy. During the interview process, a fingerprint will be taken.
NAFTA Professions
Most NAFTA Professions require a bachelor's degree, and some require experience in addition to the degree. Part-time employment is permitted but self-employment is not allowed.
Employment Letter
The employer in the U.S. must provide a Letter of Employment to the NAFTA Visa applicant. This letter should show:
- the type of work the applicant will be doing in the U.S.
- the anticipated length of stay
- the applicant's educational qualifications or credentials which show professional status
- evidence of compliance with DHS regulations, and/or state laws, and
- pay arrangements
Duration of Stay
The maximum stay under a NAFTA Professional TN Visa is one year, but extensions are granted in increments of one year.
Although there is no limit on the number of years a NAFTA Professional TN Visa holder can stay in the U.S., this visa is not for permanent residence. Applicants must demonstrate that their stay is for a temporary period which has a reasonable, finite end.
