GREEN CARD THROUGH MARRIAGE

As the spouse of a U.S. citizen, you may apply for permanent residency. Spouses of U.S. citizens are considered "immediate relatives" under immigration law; therefore they are excluded from all quota limitations. This means that there are an unlimited number of Green Cards available to foreign nationals who marry U.S. citizens.

The Application Process
The process begins with the filing of an Alien-Spouse Visa (I-130). This can be filed either with the USCIS in the United States, or at U.S. embassies or consulates abroad.

Common Law Marriages
U.S. immigration law does not recognize common-law marriages. A U.S. citizen cannot file an immigrant visa petition for a common law partner. However a common law partner may apply for U.S. residence via an employment-based visa or through the Green Card Lottery Program.
Engaged to a Foreign National
If you are a U.S. citizen who is engaged to be married to someone living outside the United States, you can obtain a K-1 Fiancée or Fiancé Visa so that he/she can come to the U.S. for the marriage.
