H-3: Company Trainee

If you coming to the United States to receive training from an employer in areas such as commerce, agriculture, government, finance, or in a professional or industrial capacity, you may qualify for an H-3 Visa.

To qualify for an H-3 Visa you must prove that:
  • you need this training to advance your career outside the U.S. and
  • the training is not available in your home country

To apply for an H-3 Visa your U.S. employer must submit "Form I-129, Petition for Nonimmigrant Worker" with the United States Citizenship and Immigration Service (USCIS).

Benefits

With an H3 Visa you may:
  • Enter into the U.S. and be trained for a period of up to two years
  • Travel in and out of the U.S.
  • Bring your dependent spouse as well as unmarried children under 21


Limitations

  • The training program must be provided by the U.S. company which petitions for you.
  • Dependents of H-3 Visa holders may not work in the U.S.
  • You may not apply for extension of stay on H-3 Visa.


Medical Training Excluded

The H-3 Visa may not be used by physicians seeking medical training or education. However, nurses may receive training in H-3 status, and foreign medical students on school vacation can participate in externships at U.S. hospitals.

Change of Status

Unlike the H-1B category, the H-3 is not a dual-intent visa, so the beneficiary cannot have immigrant intent. After the two year training period, no extension or change of status will be granted unless you have resided outside of the U.S. for six (6) months. The only exception is where an H-3 visa holder was present in the U.S. for less than six months, or where the training was seasonal or intermittent.

Only about 3000 H-3 Visas are issued each year.
