H-1C: Work Visa for Foreign Registered Nurses


The H-1C visa allows foreign registered nurses to work in the United States for up to three years. Since obtaining a green card can take several years, this visa is an option for nurses who want to work in the U.S. while awaiting permanent residency approval.

Limitations

  • Only 500 H-1C Visas are granted per year.
  • Employment is limited to areas which have been designated as "Health Professional Shortage Areas" by the Department of Health and Human Services.
Eligibility

To qualify for H-1C status, you must:
  • have a full and unrestricted nurse's license in your home country or have received nursing education in the U.S.
  • have passed the CGFNS or have a full and unrestricted license to practice as a registered nurse in the state in which you will be employed
  • be eligible to practice as a registered nurse in the state of your intended employment immediately upon your admission to the U.S.
Sponsoring Medical Facility

The sponsoring hospital/employer must (among other requirements):
  • be located in a Health Professional Shortage Area
  • be a "Subpart D" hospital (under the Social Security Act)
  • have at least 190 acute care beds
  • be reimbursed by Medicare for at least 35% of acute care inpatient days
  • be reimbursed by Medicaid for at least 28% of acute care inpatient days
  • pat at least the same wage paid to similarly employed U.S. registered nurses
  • take steps to recruit and retain U.S. registered nurses
